1. Who we are
This website, desertgreenbuilders.com (the "Site"), is operated by Omdan Development Inc., doing business as Desert Green Builders ("Desert Green Builders," "we," "us" or "our"). You can reach us at omdandevelopment@gmail.com or (760) 548-2781.
By using the Site or booking an estimate through it, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
2. Information on this Site
The Site is for general information only. Illustrations and animations are artistic examples and do not show a specific project, product, material, color, size or result. Services, materials and availability vary by location and project and may change at any time without notice. Nothing on the Site is a promise of a particular result, price, schedule or outcome.
3. Free estimates
On-site estimates are free and carry no obligation. An estimate is not a contract, an offer, a bid you can accept, or a guarantee of price or availability. Pricing is provided only in a written estimate after we see your property, and is valid only for the period stated in that estimate. Any work is performed only under a separate signed written contract that complies with California law. The terms of that contract, not this Site, govern the work, including price, scope, schedule, payment, change orders, warranties and your right to cancel.
4. Booking an appointment
An online booking is a request for an appointment. We will try to call you to confirm. We may need to reschedule or cancel an appointment because of weather, emergencies, scheduling conflicts, safety concerns, service area limits or other reasons, and we are not responsible for any loss caused by a rescheduled or cancelled appointment. To book, you must be at least 18 years old and be the owner of the property or authorized by the owner, and you agree that the information you give us is true and complete. You agree to give us safe access to the areas we need to see. Please do not book appointments you do not intend to keep.
5. Phone verification, calls and text messages
When you request a verification code, we send a one-time text message to the number you enter. By submitting the booking form and checking the consent box, you agree that Desert Green Builders may call you and send you text messages at the number you provide about your estimate, appointment and project. These may include reminders and confirmations. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to stop text messages, or HELP for help. You may also ask us to stop calling you at any time. Wireless carriers are not liable for delayed or undelivered messages. You confirm that you are the subscriber or regular user of the phone number you provide.
6. Financing
Desert Green Builders is not a lender. We do not make credit decisions, do not extend credit, and do not guarantee that you will be approved for financing or receive any particular terms.
Financing, when available, is provided by independent third-party lenders and is subject to their credit approval, underwriting and terms. Not all applicants will qualify. Statements on this Site about financing, including "$0 down," "nothing to pay for up to 24 months," "deferred payments," "0% APR" or similar phrases, describe promotional programs that may be available only to qualifying applicants with approved credit. They are not an offer of credit or a commitment to lend.
Promotional terms, rates, payment amounts, promotional periods, minimum purchase amounts and eligibility are set by the lender, may vary by lender, credit profile, project type and project amount, and may change, be limited or end at any time without notice. Some promotional plans are "deferred interest" plans: if the promotional balance is not paid in full by the end of the promotional period, interest may be charged from the original purchase date on the full promotional balance. Some plans require minimum monthly payments during the promotional period. Late or missed payments may end promotional terms and result in fees and interest. After a promotional period ends, a standard APR may apply.
Your loan or credit agreement with the lender contains the full terms and controls over anything stated on this Site or by our staff. Please read it carefully before you sign. Any questions about rates, terms, approval, payments or your account must be directed to the lender. Applying for credit may affect your credit score. We may change or stop offering any financing option at any time.
7. Licensing
Desert Green Builders is licensed, insured and bonded. Contractors are required by law to be licensed and regulated by the Contractors State License Board, which has jurisdiction to investigate complaints against contractors. You can check a contractor's license at www.cslb.ca.gov or by calling 800-321-CSLB (2752). Ask us for license, insurance and bond details at any time.
8. No warranties for the Site
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components. Warranties for any work we perform are only those stated in your written contract.
9. Limitation of liability
To the fullest extent permitted by law, Desert Green Builders and Omdan Development Inc., and their owners, officers, employees and agents, will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from or related to your use of the Site, the booking tool, the address or calendar features, text messages, or any financing information on the Site. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars ($100). Some laws do not allow certain limits, so some of these may not apply to you. This section does not limit any rights you have under a written contract with us or under laws that cannot be waived.
10. Your responsibilities
You agree not to misuse the Site, including by submitting false information, booking appointments in someone else's name without permission, interfering with the Site's operation, or trying to access systems or data you are not authorized to access. You agree to be responsible for, and to reimburse us for, claims and costs that result from your violation of these Terms.
11. Content and trademarks
The Site's text, illustrations, logo and design belong to us or our licensors and are protected by law. You may view and print pages for personal, non-commercial use. You may not copy, change or reuse them for any other purpose without our written permission.
12. Third-party services
The Site uses services from other companies, such as address suggestions, phone verification, web fonts, hosting and scheduling tools. Those services are governed by their own terms and privacy policies, and we are not responsible for them. Links to other websites are provided for convenience only.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute about the Site will be brought in the state or federal courts located in California, and you and we consent to their jurisdiction, except where the law gives you the right to bring a claim elsewhere.
14. Changes and other terms
We may update these Terms by posting a new version on this page with a new effective date. The version in effect when you use the Site applies. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. A Spanish translation is provided for convenience. If there is a difference between the English and Spanish versions, the English version controls to the extent permitted by law.

3. Estimados gratis

4. Cómo agendar una cita
Agendar en línea es una solicitud de cita. Intentaremos llamarle para confirmar. Es posible que necesitemos cambiar o cancelar una cita por el clima, emergencias, conflictos de horario, razones de seguridad, límites de nuestra área de servicio u otras razones, y no somos responsables por ninguna pérdida causada por una cita cambiada o cancelada. Para agendar, usted debe tener al menos 18 años y ser el dueño de la propiedad o tener autorización del dueño, y acepta que la información que nos da es verdadera y completa. 5. Verificación de teléfono, llamadas y mensajes de texto
Cuando usted pide un código de verificación, enviamos un mensaje de texto de un solo uso al número que escribe. Al enviar el formulario y marcar la casilla de consentimiento, usted acepta que Desert Green Builders le llame y le envíe mensajes de texto al número que nos da sobre su estimado, su cita y su proyecto, incluyendo recordatorios y confirmaciones. Dar su consentimiento no es condición de ninguna compra. La frecuencia de los mensajes varía. Pueden aplicar tarifas de mensajes y datos. Responda STOP para dejar de recibir mensajes de texto o HELP para recibir ayuda. También puede pedirnos en cualquier momento que dejemos de llamarle. 6. Financiamiento
Desert Green Builders no es un prestamista. No tomamos decisiones de crédito, no otorgamos crédito y no garantizamos que usted sea aprobado para financiamiento ni que reciba algún término en particular.
El financiamiento, cuando está disponible, lo ofrecen prestamistas externos independientes y está sujeto a su aprobación de crédito, evaluación y términos. No todos los solicitantes califican. Lo que dice este Sitio sobre financiamiento, incluyendo "$0 de enganche", "nada que pagar hasta por 24 meses", "pagos diferidos", "0% APR" o frases parecidas, describe programas promocionales que pueden estar disponibles solo para solicitantes que califiquen y tengan crédito aprobado. No son una oferta de crédito ni un compromiso de prestar.

Esos servicios se rigen por sus propios términos y políticas de privacidad, y no somos responsables por ellos. Los enlaces a otros sitios web se ofrecen solo por conveniencia.
13. Ley aplicable
Estos Términos se rigen por las leyes del Estado de California, sin tomar en cuenta sus reglas sobre conflictos de leyes.
